Terms of Service

By accessing or using BetonX services, your organization agrees to these Terms of Service and any written order form, pilot agreement, statement of work, or access notice that references them.

If you use the services on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree with these terms, do not access the services.

BetonX provides AI-enabled institutional tools for housing decision intelligence, techno-economic analysis, material discovery, binder optimization, simulation review, and validation-ready reporting.

Outputs are decision-support materials. They are not a substitute for professional engineering, legal, financial, procurement, or regulatory advice. Users remain responsible for independent review before relying on any output.

The services are intended for institutional partners, including developers, public-sector teams, engineering organizations, research organizations, and capital teams.

You are responsible for maintaining the confidentiality of account credentials, limiting access to authorized personnel, and promptly notifying BetonX of suspected unauthorized use.

You retain ownership of project data, assumptions, documents, and other materials submitted by your organization. You grant BetonX the limited rights needed to provide, secure, support, and improve the services.

You may not reverse engineer the services, use them to develop a competing product, bypass access controls, upload unlawful material, or use outputs in a way that misrepresents their assumptions, limitations, or confidence levels.

BetonX owns all rights, title, and interest in the services, platform software, workflows, models, user interface designs, documentation, know-how, and platform-generated methodology, excluding customer data.

Feedback may be used by BetonX without restriction or obligation, provided BetonX does not disclose your confidential information in doing so.

Each party may receive non-public business, technical, financial, or project information from the other. The receiving party will protect that information using reasonable safeguards and use it only for authorized service-related purposes.

Confidentiality obligations do not apply to information that is public, independently developed, lawfully received from a third party, or required to be disclosed by law.

The services are provided on an as-is and as-available basis. BetonX does not warrant that outputs will be error-free, complete, suitable for every project, or accepted by a regulator, funder, insurer, or procurement authority.

AI-assisted analysis may contain limitations, uncertainty, or source gaps. Users must verify assumptions, calculations, and cited sources before making project commitments.

To the maximum extent permitted by law, BetonX will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost opportunities, procurement delays, or project losses.

BetonX's aggregate liability for all claims relating to the services will not exceed the fees paid by your organization to BetonX for the affected service during the twelve months before the event giving rise to the claim.

BetonX may suspend access if use creates security risk, violates these terms, infringes third-party rights, or could harm the services or other users.

Either party may terminate access according to the applicable agreement. Upon termination, your right to use the services ends, but provisions that by their nature should survive will continue to apply.

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law principles.
